Mid Sussex District Council has launched a legal challenge against the Secretary of State for Housing, Communities and Local Government following concerns raised by the Planning Inspectorate over the soundness of its emerging District Plan.
The Plan, which is intended to guide development in Mid Sussex up to 2039, was designed to deliver sustainable growth while protecting the area from speculative proposals. However, after its public examination in November 2024, the Council waited five months for a response—only to be told it had failed to meet the legal Duty to Cooperate with neighbouring councils. The Inspector found that Mid Sussex had not provided sufficient evidence of effective engagement, particularly with Crawley and Horsham.
While the Council argues that it is planning to accommodate an additional 1,000 homes to help meet wider regional needs, the Inspector concluded there was no clear or ongoing collaboration, nor clarity on where those homes would be delivered.
The implications are serious. Without a sound plan in place, Mid Sussex may be left without an up-to-date planning framework—potentially for several years. Restarting the process could take the Council beyond 2028, when it is expected to be dissolved as part of wider local government reorganisation.
In response, the Council has obtained legal advice and confirmed it will challenge the Inspector’s conclusions to protect the area from unplanned and opportunistic development.
