Our client purchased a site in the Green Belt which benefitted from planning permission to construct three new dwellings on large plots. Part of that permission included an area of land left undeveloped and earmarked to become open space. Squires Planning were asked to review the situation and advise on the development potential of this area. That review identified that the site constituted an infill site and as such a new dwelling on it should be acceptable in the Green Belt, despite local planning policies to the contrary, and was in a good location. We advised that a new dwelling should be possible but we would meet resistance from the Local Planning Authority and an appeal would likely be needed.

Following the review, we progressed a planning application for a new dwelling. This was refused by the Council as they considered it was constituted inappropriate development in the Green Belt and would result in an encroachment into the countryside which would be detrimental to the site's open rural character. Subsequently we progressed an appeal setting out the planning justification and balance that we felt the Council should have adopted. The appeal Inspector agreed with us that the site constituted infill development and a new dwelling was acceptable in principle, but unfortunately took a dislike to the design of the proposed dwelling and dismissed the appeal on design/character grounds.

Following the appeal we had discussions on the best way to proceed with the Council, and it was agreed that a revised design/proposal on the site would likely be supported now the Inspector had confirmed the site constituted Infill in the Green Belt. A new architect was brought onboard who prepared a revised proposal and, guided by ourselves, a Townscape Character Assessment of the village to demonstrate that positioning of the dwelling was in accordance with the built grain of the settlement. 

The application was approved under delegated powers.

Following grant of permission, we progressed the discharge of condition applications and assisted with CIL matters to enable a start on site.
